ADVANCED INTERFACE BETA TEST AGREEMENT
This Agreement is between You and Trade Exchange Network Limited, an Irish Company with its principal place of business located at 10B Park West Business Park, Dublin 12, Ireland. ("TEN"). BY PRESSING THE "I ACCEPT" BUTTON OR USING THE INTERFACE, YOU ACCEPT, WITHOUT LIMITATION OR QUALIFICATION, ALL OF THE TERMS AND CONDITIONS IN THIS AGREEMENT, AS WELL AS OUR EXCHANGE RULES, CONTRACT RULES, PRIVACY POLICY, DATA PROTECTION POLICY, AND DISCLAIMER WHICH IS HEREBY INCORPORATED BY REFERENCE. If You do not accept all of the terms and conditions of these Agreements, do not use the Interface.

Acknowledgement. This Agreement sets forth the terms and conditions governing Your access to and use of the Interface known as the Advanced Interface for the sole purpose of beta testing the Product. For the purposes of this Agreement, the term "Product" or “Interface” shall include all of the information, services, features, functions and materials contained in the Interface, and all of the software, source code, and design configuration used on or in connection with the Interface.

Use of Product; License. Subject to all the terms and conditions of this Agreement, TEN hereby grants to You a personal, royalty-free, non-sublicensable, nontransferable, nonexclusive license to use the Interface solely for beta testing purposes during the term of this Agreement. You agree to use the Product only in the ordinary course of testing, and not to reproduce, distribute or modify any portion of the Interface. You shall not reverse assemble, reverse compile or reverse engineer any software source code or other components of the Interface, or otherwise attempt to discover any underlying Proprietary Information (as that term is defined below).

Ownership. Except as expressly licensed in Section 2 above, as between the parties, TEN owns all right, title and interest in and to the Interface and Proprietary Information.

Evaluation. You are invited to submit any comments you may have on the Interface by e-mail, including any information about errors, bugs, crashes, failures, unexpected results, other problems, as well as any workarounds, fixes, patches or rewrites you have developed. You agree that TEN shall have, and You hereby assign to TEN, any and all right, title and interest in and to any suggested modifications, design changes, features or improvements to the Product that You suggest, without the payment of any consideration therefor, and TEN shall have the right to use, in any manner and for any purpose whatsoever, any information provided by You hereunder.

No Training or Support. You acknowledge and agree that TEN shall have no obligation under this Agreement to provide any training or to correct any bugs, defects or errors or to otherwise support, develop or maintain the Interface.

Warranty Disclaimer. The parties acknowledge and agree that the Product is experimental and may not function correctly or at all and is therefore provided "AS-IS" and at Your sole risk. TEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES AGAINST INFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TEN MAKES NO WARRANTY TO ANY PERSON RELATING TO THE PRODUCT, ITS USE OR ANY INABILITY TO USE THE PRODUCT, THE RESULTS OF ITS USE, THAT ERRORS IN THE PRODUCT WILL BE CORRECTED, OR THAT THE PRODUCT WILL EVER BE COMPLETED OR COMMERCIALLY AVAILABLE. NOTHING IN THIS AGREEMENT SHALL BE CONSTRUED AS PERMITTING YOU TO RELY IN ANY WAY ON THE CONTINUED USE OF THE PRODUCT OR ANY FURTHER DEVELOPMENT OR FUTURE RELEASE THEREOF.

Term and Termination. The term of this Agreement is three (3) months, provided TEN has not earlier terminated this Agreement as provided in this Section 7. TEN reserves the right to terminate your rights under this Agreement and may so terminate for any reason or no reason.

No Assignment. Neither the rights nor the obligations arising under this Agreement are assignable or transferable by You, and any such attempted assignment or transfer shall be void and without effect.

Controlling Law. This Agreement shall be deemed to have been made in, and shall be construed pursuant to the laws of Ireland, without regard to conflicts of laws.

Severability. In the event that any of the provisions of this Agreement shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable, while most nearly giving effect to the intent expressed herein.

Entire Agreement; Amendment; Waiver. This Agreement, along with the End User License Agreement discussed in Section 11, constitute the entire agreement between the parties pertaining to the subject matter hereof, and supercedes any and all written or oral agreements heretofore existing between the parties.

Express Notice. TEN draws your attention to the following features of the Interface subject to the above Section 6, Warranty Disclaimer.
The purpose of the INTERFACE is to allow you enter, cancel and update multiple orders in an efficient manner. The INTERFACE is meant for the sophisticated user and the level of protection that the normal Trading Screen offers is NOT provided by the INTERFACE. Specifically you do NOT need to confirm an entry of an order with the INTERFACE like you do with the normal Interface. Therefore users are advised only to use the INTERFACE if they are fully satisfied that they know and understand how it works.
The INTERFACE gives you NO execution advantage over the normal Interface.
It is strongly recommended that you familiarize yourself with these explanations and work through the INTERFACE functionality several times.
The INTERFACE is comprised of several frames.
Frame 1 "Active Events"
Select the Events you want to trade
Frame 2 "Type of Order"
GFS means that the order is good for the trading session.
GTC means the order will remain on the book till you cancel it or the contract expires
GTT means the order will be valid until the time specified in the Cancel Time input box
Frame 3 "Order Size"
This is the default size of bids and offers entered – The Exchange set default is
100 contracts.
To change default setting, enter new quantity.
Frame 4 “Tick Increment”
This is the price +/- change in ticks on new orders entered to replace last orders entered through the INTERFACE
Change Tick increment to personal setting
Use side-arrows on order ticket to change prices.
Frame 5 “Market Data”
“*” denotes depth in the order book. Mouse over shows other orders behind the best bid and offer.
Colour change on screen indicates some activity has taken place in that contract since the last refresh.
e.g. Trade occurred, order entered/cancelled etc.
If a trade has taken place, the “Qty” for that contract is displayed in bold.
Over round totals value of all bids and offers in market
You can adjust the auto refresh to your personal settings
Frame 6 “Working Orders”
Shows your current working orders in this market
Over-round at end totals the value of all bids and all offers for linked contracts
P/L – notional P/L if one contract expires at 100 based on current position for linked 0-100
contracts. “ng” signifies that the contract is not in a group
“*” denotes depth in working orders. Mouse over shows other orders behind the best bid and offer.
“Cancel All” cancels all open orders in the event. Alternatively hitting F12 performs this function.
Frame 7 “Order Ticket”

Reset - resets value of bids/offers to value in current working order

Untick – unticks the checked boxes: used if you only wanted to change some orders, not all.

Tick –checks to all boxes that correspond to a valid order entry

Def – returns order size to default - to change this default see ‘order size’ above

Cancel - cancels current working order (if ticked)

Update – hit to enter new orders – this acts as a cancel replace – cancels last (if ticked)

After Cancel or Update are clicked, the buttons are greyed out. These buttons will be activated
again when the “Working Orders” panel automatically refreshes in 5 seconds. If they stay greyed
out, they can be re-enabled by manually refreshing the “Working Orders” panel by clicking on
the “Refresh” symbol.
Frame 8 “Messages”
Messages are checked every 11 seconds. If a new message is detected the “Working Orders”
panel is automatically refreshed and the message is downloaded. Newer messages are at the
top of the list. A “New Message” indicator appears on the top left of the screen. This can
be hidden by clicking on the “Check Messages” link.
